Have you ever been hit by an uninsured driver? If you have then you probably know the procedure regarding how to claim. However, if you are lucky enough to have never been hit by an uninsured driver then the idea might seem like a complete and utter nightmare to you. Well, it should be because it is if you have no idea how to claim for that and you realise that most car insurance quotes do not cover you for it!
Car insurance quotes may or may not cover you for uninsured drivers because the individual providers hate paying for them. It costs them millions of pounds every year. This riles some to the point of not providing cover for that event. Of course, the fact that there are more uninsured driver accidents than ever before now will not bring your car insurance premiums down.
You should firstly check your car insurance policy to see whether or not you are covered in the event of an accident involving an uninsured driver. If you are then you are one of the lucky ones that is just required to claim in the regular way via the provider itself. However, if you are not covered under your insurance company then you will have to pursue compensation by yourself.
It may sound a little bizarre but it can take you years to get any compensation if you are not covered under your car insurance policy. If you do have cover then you can claim back the money to repair your car or replace it minus the excess. However, if not then you need to go through the Motor Insurance Board (MIB) instead.
The MIB was established to help motorists that have been the victim of an uninsured driver. They do not directly compensate you but they will take legal action against the uninsured driver on your behalf to get compensation for you by way of the courts. The uninsured party will have no choice but to pay up eventually. However, you have a series of steps to follow first.
Firstly, you should double check that the individual is not insured by running a DVLA vehicle check and then lodging a formal complaint with your local police force. It is obviously an offence to drive without insurance but it is also one to refuse to give insurance details in the event of an accident. Even if you cannot claim with them, you should also tell your car insurance company about the accident so they know. This is a requirement of most policies.
You should then put in a claim with the MIB. You can download the form online and send it over the Internet or via post. You have to provide them with as much information as possible and then they will take it from there. You should claim as soon as possible to ensure that there are as few delays as possible.
Taking each case through the courts understandably takes time but you are entitled to that money. After all, you are forced to pay around 30 pounds extra a year as a result of uninsured drivers. You may have to wait but you can get the compensation you deserve.
