When applying for a no contest divorce, it is essential that your papers are presented correctly, and most importantly: you use the correct form for your State.
This is quite a common problem, people believing that one legal divorce form fits all.
Since all the States entered into the "no fault" divorce process, with New York being the last to agree, a divorce can now be handled with minimum fuss and even without a lawyer if you are happy with the process.
Not much documentation is required for this; obviously the correct form being the most important point, and you may be subject to resubmission fees should you form, or its details be incorrect.
My own divorce went very well recently, some say better than the actual wedding, if that's understandable. What simplified things was the fact that we had prepared...a lot. We had each agreed on what we would be taking from the marriage, and the costs were very low, apart from the fact that I used a lawyer as I am a bit of a coward.
My ex presented her own case and did an excellent job of it too. She seemed confident, and in control of her situation, whereas I was a bit of a mess with terror in my eyes, and panic in my heart, as I hate formal gatherings, and speaking in public, no matter how small and official the audience.
We both walked away with 50% each of the spoils (as planned), and I had a small bill from the lawyer. And that was it.
This can be done, and you can do it too, all it takes is a little co-operation between you and your soon-to-be ex-partner in the early stages (this can be the most painful part of the process), some thorough reading/research, some confidence, and a bit of your valuable time.
Is this difficult? You could walk away with everything you want, and maybe more (including a bank account intact).
What a bargain for such little effort.
